Terms and Conditions of Trading.

Full payment is required upon realistic completion of the works and paid in full within seven days of the date on the invoice. Any defects/concerns regarding works carried out must be reported within 7 days of our attendance in order to allow us the chance to respond and/or rectify issues. Failure to do so shall indicate that works have been completed to the client's satisfaction and that full payment is due as stated. When carrying out a Landlord Gas Safety certificate, if a compliant Carbon Monoxide detector is not present, we will supply and fit one at a cost to the client of £35 + vat.

We do not carry out works to Aga's. If an Aga is present and requires switched on/off in order to carry out agreed works then we will ask the client to do so. If the client asks the engineer for assistance, we cannot be held responsible for any issues or breakages to switches or parts.

If the heating system requires to be drained as part of the proposed works then in the event that any debris or sludge within the system moves during the draining so as to cause blockage or other issues, or in the event of an airlock, we cannot be held responsible. We will endeavour to provide a quote to rectify any such issues.

Boiler installations may require additional authorised trades to be onsite carrying out specialised works. All such contractors have been approved by Scott Findlay.

When converting any heating or domestic water system which involves increasing the pressure, we cannot be held responsible for any existing fittings or pipework which may leak.

Failure to allow an undersized gas pipe to be upgraded may affect the manufacturer’s guarantee. The client will be invoiced for the total installation amount quoted.

If, at the time of commissioning, the incoming gas supply is found to be low, we will contact SGN to report the defect. It is their responsibility to rectify any issues in the supply pipe or at the gas meter. In such instance, we will invoice for the installation as quoted, with a retention of £150 + vat to allow for us to return to carry out final commissioning after SGN have rectified the defect.

We undertake to repair, or if necessary, replace free of charge, any defective materials or work found to be defective if the defect is due to faulty materials supplied by or defective workmanship of Scott Findlay and brought to our attention within 12 months of the completion of works, provided that such repair or replacement will only be carried out by Scott Findlay Ltd, his servants or agents. Failure by the client to follow this condition and allow another

contractor to inspect the works prior to Scott Findlay being given the right to reattend will result in the undertaking in terms of this clause becoming null and void.

**The following notes relate more specifically to the installation of new boilers.

The estimate presumes that the client’s current heating system is piped in accordance with best practice and in line with schematic diagrams included in manufacturers’ instructions. Any issues caused with the operation of the new boiler as a result of non standard piping/design will be subject to an additional charge which will be discussed with the client before commencement of rectification works.

Unless otherwise stated, the estimate provides for laying cables, conduit and pipe-work runs by the most economical and practical routes.

Any additions or variations to the works, including any change in the manner in which or the time at which the works are to be carried out shall be charged on a time and material basis or shall be the subject of a separate estimate and the value agreed, where it is practicable to do so before the work is carried out.

Title of any goods supplied or installed by the Contractor shall remain with the Contractor until full payment has been made for these goods.

We accept no responsibility for the materials or work carried out in accordance with drawings, designs or specifications prepared by persons for whom we are not responsible.

We shall take reasonable care while carrying out the works but, unless specifically included in the estimate, the price does not otherwise include incidental redecoration or other related works which may be required upon the handover of the works duly completed.

The works will be carried out so as to comply where appropriate with the Building Standard (Scotland) Regulations, the current edition of the IEE Wiring Regulations for Electrical Installations, Gas Safety (Installation and Use) or any other relevant regulations.

The client shall obtain all permits or other approvals necessary to carry out the works covered by this agreement (including without prejudice to the foregoing generality any Local Authority Consent) and pay all associated fees.

We shall use all reasonable endeavours to complete the works within the period stipulated in the estimate, or if no period is agreed prior to the commencement, then within a reasonable time. We shall not be responsible for any delay, loss or damage whether direct or consequential, arising out of any cause that is beyond our control.

Unless previously withdrawn, the offer will remain valid and open for acceptance in writing for 90 days from the date specified on the estimate.

We do, however, reserve the right to terminate any call which we believe to be verbally abusive or offensive.

We also reserve the right to refuse to accept you as a customer or continue dealing with you if we believe your behaviour is disruptive, threatening or abusive, you damage property, you upset, or put any of our employees or subcontractors in risk or danger.
